Terms & Conditions

1. The customers trading in derivative segment will have the option to use the “Smart Option Strategies” where they will have the option to use the “Pre-defined Strategy” or built their own strategies i.e. “Customized Strategy”.

2. The customer agrees and understand that the aforementioned strategies shall only be executed under the defined entry and exit parameters set by the customer at his sole discretion.

3.The customers agree and understand that once a strategy is set only the exit parameters can be modified. The customer needs to either delete the set strategy prior to execution or wait till the execution of the exit parameters.

4. The customers agree and understand that any strategy placed should not be managed manually as it ascertains risks of creating additional positions. To close any open position, the customer can use the “Square off Feature” available under the “Smart Strategy” or delete the set strategy.

5. The customer deem to agree and understand that by opting for these strategies they shall be levied an additional amount of Rs.20/- (Rupees Twenty Only) per order to their existing brokerage plan.

6. The customers understand that for the execution of their set strategies they are mandated to log into their account prior to the scheduled strategies’ time. Due to any reasons, if the customers fail to log into their account prior to the scheduled strategies’ time, no trades will be placed on the said date.

7. The customers understand that for the execution of any strategy minimum margin requirement needs to be maintained by them. In case any customer fails to maintain the requisite margin that is mandated for the execution of the designated strategy, the said trade shall be rejected by the system on account of insufficient margin.

8. Once the customer has stopped the set strategy, all the future scheduled trades shall be stopped with immediate effect and the customer shall manually manage their trades and positions.

9. The customers agree not to circumvent, remove, degrade or deactivate any of the contents of the trading interface provided by 5paisa and / or use any robot, spider, scraper or other means to access the trading interface. The customers further agree not to decompile, reverse engineer and disassemble any software or other products or processes accessible through the trading interface provided by 5paisa and not to insert any code or product or manipulate in any way, or use any data mining, data gathering or extraction method on the trading interface.

10. The customers agree not to use any product which modifies, changes, adds to or subtracts from the source code, graphical user interface, structure, integration, look and feel or features this product.

11. 5paisa reserves the right at any time, without notice, to add/alter/change/ or vary any or all of these terms and conditions. In the event that any changes are made, the revised terms and conditions shall be posted on 5paisa’s website immediately. The customers agree to check the latest information posted in 5paisa’s website and keep themselves updated about the changes (if any). If the customers do not agree to the change(s) made to the terms and conditions, should immediately cease their use of this product and cancel their subscription.

12. 5paisa reserves the right to immediately cancel this subscription of any customer or discontinue this product, at any time without any prior notice. 5paisa shall assume no responsibility, whatsoever, for any damages caused to the customers or third parties as a result of the stoppage of this product. The decision of 5paisa with respect to this product shall be final and binding on the customer.

13. 5paisa reserves the right to disqualify any customer from the benefits of this product if any fraudulent / manipulative activity is identified as being carried out for the purpose of availing the benefits under this product.

14. All taxes, duties, levies or other statutory dues and charges payable including brokerage in connection with the benefits accruing under this product shall be borne solely by the customer and 5paisa will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues.

15. The terms and conditions governing this product shall be in addition to and not in substitution / derogation to the primary Terms and Conditions applicable to the customers of 5paisa.

16. The customers subscribing for this product shall be deemed to have read, understood and accepted to be bound by these terms and conditions applicable thereon. The customers continued use of this product shall indicate their acceptance of the latest version of the terms and conditions of this product.

“Smart Strategies” refers to automated trading and execution strategies which are well designed to adapt to the market condition and execute trades basis the application of pre-defined logic.

The investor hereby confirms that he is aware that the strategies are automated and 5paisa does not take any liability for any loss generated by the same. The decisions to buy, sell, hold or execute trades in any securities and other investments involve lot of risk and hence it is recommended to seek advice of qualified financial professionals / advisors before executing the same. Further, such trading in securities or such other products involves a risk of substantial losses. Hence, the investor is requested to carefully ascertain whether such trading products are suitable considering their financial condition and the ability to bear financial losses (if incurred). 5paisa makes no representation that availing the “Smart Strategies” product will result in profitable trading or be free of risk from any loss. 5paisa requests its investors to maintain caution while trading as derivatives trading and algorithmic trading involve a substantial risk of loss and may not appropriate for everyone. All the investors are requested to carefully consider their investment objectives, level of experience and ability to tolerate risk/losses prior to trading or investing. There could also be a possibility that the investor could sustain a loss of some or all their initial investment.  

The past performance of advice/strategy/model does not indicate the future performance of any current or future strategy/model or advice by 5paisa. It is merely used for illustration or example purpose. 5paisa makes no representation that any account will or is likely to achieve profits or losses like those illustrated. 5paisa urges its investors to understand that there are numerous factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in a preparation of hypothetical performance results and all of which can adversely affect actual trading results. The actual trading returns may differ significantly from that depicted herein due to various factors including but not limited to impact costs, expense charged, timing of entry/exit, timing of additional flows/redemptions, individual investor mandates, specific portfolio construction characteristics etc. 5paisa gives no assurance or guarantee that the objectives of any strategy/model or advice provided in “Smart Strategies” product will be achieved. Neither 5paisa Capital Limited nor any of its affiliates, subsidiaries or representative can assure or guarantee for any return on the investment in strategies/models/advice given to the Investor. The value of investment can go up or down depending on factors & forces affecting securities markets.

5paisa is not liable or responsible for any loss or shortfall whatsoever arising from operations or affected by the market condition and the investors shall be solely responsible for their own losses (if any). This disclaimer shall be applicable to any investor visiting, accessing, or availing the services of the “Smart Strategies” product.
